Terms and conditions

These general payment and cancellation conditions apply to all courses listed below, however,
they are subject to any contractual conditions listed for individual courses

Yoga and Ayurveda course in India

1. Introductory Provisions 

1.1. Course provider
The course provider is Yoga Surya International India, T-2/947, Rashtrabhushan, So, Rupeenagar, Pune 412114, Maharashtra, India (hereinafter referred to as the “Provider”).
1.2. Subject of business
The provider specializes in organizing courses, training and educational events, including teaching activities. Provider contact: email: info@yogasurya.in, phone: +91 9049106554.
1.3.These terms apply to the Yoga and Ayurveda Course in India.

2. Subject of the contract

2.1. Contractual relationship
This contract (hereinafter referred to as the “Contract”) regulates the conditions of participation in courses organized by the Provider. By submitting an order, the course participant (hereinafter referred to as the “Participant”) agrees to these terms and conditions and undertakes to comply with them.
2.2. Course subject
The provider undertakes to provide the participant with the opportunity to take a yoga and Ayurveda course in India, according to the conditions set out in these terms and conditions.
2.3. Binding order
By submitting the registration (hereinafter referred to as the “Order”), the applicant confirms that he agrees to these terms and conditions and that he is familiar with the content of the course. The order becomes binding after the payment of the course fee or deposit for the course fee.

3. Fees and Payments

3.1. Course price
The participant undertakes to pay the total price for the course in the amount of CZK 34,000, which includes tuition and some services related to the course, but does not include the costs of air tickets and visas. The course fee is payable to the account of the Provider: IFSC Code: HDFC0000185
Account No.: 50100680015341. As a variable symbol, the Subscriber must enter his nine-digit telephone number without the international area code (eg “602123456”).
3.2. Airline and visa fees
These fees are not included in the course price and the Participant is obliged to pay them separately. The Provider may assist the Participant in purchasing tickets, but is not responsible for flight-related problems.
3.3. Refund of fees
Ticket fees are subject to the terms and conditions of the airline and the participant bears full responsibility for dealing with the purchase of tickets and their eventual cancellation. If a course participant is unable to attend, a substitute can take his place. In such case, the payment for the course will be refunded in full once the replacement participant has paid the full amount.

4. Cancellation terms

The participant has the right to cancel participation in the course under the following conditions:
a) cancellation within 15 days before departure: Payment of service fees in the amount of CZK 8,000.
b) cancellation between 15 days and the day of departure: Cancellation fee of 50% of the course price.
c) cancellation after departure: 100% cancellation fee
This system of cancellation fees ensures a fair distribution of risks and costs between the participant and the provider.

5. Participant Exclusion

The provider reserves the right to exclude a participant from the course if:
a) the participant disrupts the course program or does not participate without a valid health reason.
b) the participant threatens the safety of other participants.
c) the participant does not respect local cultural rules
d) consumes alcohol or drugs.
In the event of expulsion, the participant is not entitled to a refund of the course fee. All expenses for the organization of the trip and accommodation must be covered by the excluded participant at his own expense.

6. Participant’s Liability.

The participant is obliged to:
a) observe cultural rules and respect local customs.
b) behave irresponsibly or in violation of local laws and regulations.
c) not to rely on the organizer in case of personal problems outside the scope of the course (e.g. health problems, personal safety, etc.).

7. Warranties and liability of the Provider

7.1. The provider guarantees that:
a) provide the participant with services as specified in the course description and these terms and conditions.
b) will try to ensure safe and comfortable conditions for participants in accordance with local customs.
7.2. The provider is not responsible for:
a) delays or changes in the program due to unforeseen circumstances (eg weather, political changes, natural disasters).
b) any health problems of the participant, if they are caused by his own behavior or previous health condition.

8. Transfer of rights and obligations

The participant can transfer his participation to another person (substitute) if the total amount for the course is paid and the substitute meets all the conditions of participation. This transfer must be agreed with the organizer before the start of the course.

9. Governing Law and Jurisdiction

All disputes arising in connection with these Terms and Conditions or the Course shall be governed exclusively by the laws of India and shall be subject to the jurisdiction of the District Court of Uttarkashi, Uttarakhand, India.

10. Final provisions

10.1. This contract is valid and effective from the moment the Participant confirms his participation in the course, either electronically or in writing.
10.2. All changes or additions to these terms and conditions must be made in writing and approved by both parties.
10.3. This framework of legal conditions provides both parties with a clear understanding of the legal obligations and conditions under which the course will take place, and at the same time protects their rights in the event of non-fulfillment of obligations or the emergence of legal problems.
10.4. This course is organized by the Yoga Surya International India institution with the support of Ajay Laxman Bobade, apartment Hrobičany 10, Sběř, ID: 275 18 990. Ajay L. Bobade only provides free organizational support.

11. Personal data protection (GDPR)

11.1. Personal data manager
The controller of personal data is Yoga Surya International India
11.2. Purpose of processing
The provider processes personal data of course participants for the purpose of registration for courses, administrative management of the course, communication about the course and securing payments.
11.3. Types of personal data
The following information is processed: name, surname, e-mail address, date of birth, residence, telephone number, payment details (e.g. bank details), personal photo, copy of passport and visa (for various permits in India)
11.4. Legal basis for processing
The data is processed based on the consent of the participant and for the fulfillment of the contract for participation in the course.
11.5. Data retention period
Personal data will be kept for the duration of the course and subsequently for administrative purposes, for a maximum of 5 years.
11.6. Participant rights
The participant has the right of access to personal data, correction, erasure, restriction of processing or portability of data.
11.7. Safety
The provider takes the necessary measures to protect personal data from misuse and loss.
11.8. Agreement
By placing an order, the participant agrees to the processing of his personal data for the purposes specified in these terms and conditions.
11.9. Consent to share photos
The Participant agrees that the Provider may take and share photographs and videos of the Course in which the Participant may be captured for the purpose of promoting and presenting the Courses. The participant can withdraw this consent in writing at any time.
